Covid-19 Testing Services T&C's

These terms and conditions constitute (med)24’s service specific COVID-19 Testing Services Terms & Conditions, which are referred to in our Services Terms & Conditions and form part of that agreement by providing additional clauses to that agreement. Unless otherwise stated, any definitions used in these terms are as stated in our Services Terms & Conditions. Depending on the type of COVID-19 testing service we provide – PCR Test or Lateral Flow Device (LFD) Test – we work in conjunction with a number of laboratories and service providers, including Circular 1 Health, Covid Testing Laboratories, PeploBio and Effect Doctors (together known as the Laboratories) the terms and conditions of each relevant processing lab and/or service provider will also apply to the COVID-19 Testing Services we provide to you:

In order to register your swab on the relevant lab’s portal you will need to accept the lab’s terms and conditions. Please read our Services Terms & Conditions before purchasing your COVID-19 test. By proceeding with your order, you are agreeing to our Services Terms & Conditions including these specific COVID-19 Testing Services Terms & Conditions.

1. PCR TESTING
1.1 You may test for COVID-19 with (med)24 by using a government approved PCR testing provider.
1.2 By purchasing these tests, you are consenting to (med)24 to share your data with Circular 1 Health who will report your test results to United Kingdom Health Security Agency (UKHSA).
1.3 You may take a COVID-19 PCR test with (med)24 by:
1.3.1 attending our clinic to be swabbed or to self-swab;
1.3.2 self-swabbing using a (med)24 swab and arranging for the swab to be transported back to our Clinic as agreed with (med)24 via: a) special delivery post; b) courier; or c) in person.
1.3.3 arranging for a courier to: a) drop off a testing kit and collect the swab to transport it back to our Clinic and collocated C1H lab in Paddington or another testing lab as agreed with (med)24; or b) drop off a testing kit, wait while you self-swab and transport your swab back to our Clinic and collocated C1H lab in Paddington or another testing lab as agreed with (med)24.
1.3.4 arranging for a (med)24 clinician to visit you at an agreed location to be swabbed and the clinician will transport the swab back to our Clinic and collocated C1H lab in Paddington or another testing lab as agreed with (med)24.
1.4 In the first instance, the testing laboratory processing your swab will inform you of your results and/or provide you with an appropriate test certificate.
1.5 Please note, you must provide us with all Government mandated testing details in order to receive a booking reference number for the Government Travel Locator Form.

2. SWABBING IN CLINIC
2.1 In-clinic swabbing is not automatically scheduled when you purchase an in-clinic PCR test.
2.2 You can either book your swab time on our website at checkout or you should contact us to book your in-clinic PCR test swabbing.

3. SELF-SWABBING & DROP-OFF
3.1 If you wish to test by dropping-off your swab at our Clinic, you should self-swab, put the swab in the return packaging in accordance with the instructions and arrange for the swab to be brought to our Clinic. You can drop off the swab 24/7. Our address is: (med)24, 10 Eastbourne Terrace, Paddington, London W2 6LG.
3.2 On arrival, you will find the drop-off box for swabs is clearly labelled (med)24 and is located in the foyer within the reception area at 10 Eastbourne Terrace, Paddington W2 6LG. The reception area is manned 24/7. Outside of regular business hours, the entrance doors are locked but a security guard will let you in. If you make your own arrangements to transport the self-swab to us, please email us to let us know the time we should expect the swab to arrive at the Clinic.
3.3 If you would like us to arrange a courier to transport your self-swab to Paddington, call our concierge team to make the arrangements.
3.4 You must contact us to book couriers; these are not included in the price of the test kit and are not automatically scheduled.

4. LFD TESTING
4.1 You may test for COVID-19 with (med)24 by using a government approved LFD testing kit.
4.2 The test requires you to self-swab.
4.3 Testing kits can be collected at the clinic, posted, or couriered to a location of your choice.
4.4 For general LFD testing, you will be responsible for reporting your results to https://www.gov.uk/report-covid19-result within 24 hours of your result.
4.5 By purchasing these tests, you are consenting to (med)24 to share your data with either Covid Testing Laboratories or PeploBio who will report your test results to UKHSA.
4.6 For Fit to Fly LFD self-testing, your result will be verified by Covid Testing Laboratories. 4.7 For Day 2 LFD self-testing, your result will be verified by PeploBio.

5. POSTAL DELIVERY 5.1 If you wish to test using the postal orders systems, any purchases made by you before 2pm between Mondays – Thursdays or before 12pm Fridays will be dispatched on the day of purchase. 5.2 Any purchases made after these times will be despatched next working day (excluding Saturday & Sundays). 5.3 If you select to receive your testing kit through the post, it will be posted via Royal Mail Priority. 5.4 Upon booking a postal service, you will receive an email confirming the purchase. 5.5 We do not accept postal delivery of PCR self-swabs. If you do send your swab to us via post you do so at your own risk as to whether we receive it at all and if we do receive it whether it is within the 72-hour timeframe from time of swabbing that the Laboratories require in order to be able to process the swab.

6. COURIER DELIVERY
6.1 Should you wish to book a courier to:
6.1.1 send an LFD test to you; or
6.1.2 send a PCR test to you and/or bring it back to the Clinic, you must call us to arrange this – it will not automatically be scheduled for you.
6.2 By purchasing your testing kit and requesting a courier service, you agree to any additional charges to be incurred if a courier is organised by our service on your behalf.
6.3 An estimate cost of the courier service you require will be provided to you before you confirm the courier service.

7. CHANGES TO COVID-19 TRAVEL REQUIREMENTS
7.1 Although we keep abreast of the continually changing government requirements, we can only advise on the products and services we provide at (med)24.
7.2 It is your responsibility to understand the latest travel requirements for your individual needs by visiting gov.uk/coronavirus or speaking to your travel provider.
7.3 (med)24 will not take responsibility for any mistakes or cancellations caused by the customer.
7.4 Should government travel policy change, at no fault of the customer, we will offer full refunds on the products ordered.

8. DATA SHARING 8.1 In purchasing a COVID-19 testing service from us, you consent to having (med)244 store information for legal reasons. If your test returns a positive result (this applies to PCR swab samples only and not LFD tests or antibody tests), we will be required by law to share the following information with the Laboratories and UKHSA:
8.1.1 your name 8.1.2 your contact phone number
8.1.3 your email address 8.1.4 your self-isolation address in the UK

9. LIMITATION OF LIABILTY
9.1 Any purchases made by you are for private use only and you agree not to use them for any commercial purpose. Therefore, we are not liable to you for any loss of profit, loss of business or revenue, business interruption or loss of business opportunity arising out of your use for any commercial purposes.
9.2 We are also not liable to you for any errors in the test results which are due to your handling or storage of the purchased test kits from us, any errors made by you in administering the tests, submitting your results or information to a portal or designated email address, and any damage caused during transportation.
9.3 We provide these testing services in conjunction with the Laboratories, the Royal Mail, and various courier companies (together known as the Suppliers). We cannot control their services and are not responsible for any failures in the accuracy, quality or timeliness of their services.
9.4 In so far as is legally possible, med(24) excludes liability, for costs, expenses, damages and losses (including any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs and any professional costs and expenses) suffered or incurred by you arising out of or in connection with any failure by med(24) to comply with its obligations under these COVID-19 Testing Services Terms & Conditions which arise as a result of the acts or omissions of Suppliers (or any of them) in relation to the services they provide to med(24) or to you under these COVID-19 Testing Services Terms & Conditions.
6.1 References to liability in this clause include every kind of liability arising under or in connection with this agreement including but not limited to liability in contract, tort (including negligence), misrepresentation, restitution or otherwise save we do not exclude or limit in any way our liability for:
6.1.1 death or personal injury caused by our negligence (including the negligence of our employees, agents or subcontractors);
6.1.2 fraud or fraudulent misrepresentation; and
6.1.3 breach of the terms implied by sections 3, 4 and 5 of the Supply of Goods and Services Act 1982 (description, satisfactory quality, fitness for purpose and samples).
